Overview:

Great leaps in trade and commerce, vigorous strides in economic viability and vibrating thrust in the banking system as a nerve centre of economic activity, is the clarion call and the reality of today. Its effective growth is the sine qua non of the inherent strength and prosperity of the nation. "Cheque" is one of the instrumentalities that has brought variety, vastness and versatility in the banking system that transacting of business has started revolving around this magical valuable security. To bring dimness to its lustrous shine has been now considered an offence and section 138 of the Negotiable Instruments Act, 1881 stands as a beacon tower for those who persist in indulging in acts of sacrilege of degrading the sanctity of the cheque.Apart from the existence of the statutory provisions, judicial interpretations have added new dimensions with catena of cases on the subject. Attempts have been made by various authors to facilitate the legal profession to have an easy access to the entire case law on the subject and their contribution is praiseworthy. The Author have also endeavoured to deal with the subject with a simple touch of clarity with an overt object of bringing vivid understanding of the intricacies involved due to varying interpretations given judicially.
