Environmental jurisprudence has drawn its knowledge base fromdifferent disciplines of studies like basic sciences, earth scienceand Common Law jurisprudence. Study of this discipline isconcerned more with enforcement ‘rights’, for environmentalpollution may affect individuals as well as the public at large. Theimpact of pollution may be on the lives of people in the place ofoccurrence as well as in a larger geographical territory. Further, theimpact might be even larger on generations to come. Therefore, if pollution is termed either as a wrong or crime, it requires differentunderstanding of law because of its very nature, wherein the studyof environmental jurisprudence gains importance. This book seeksto fi nd the answer of the question, in case of pollution, who isresponsible for the pollution, ie, how is the onus to be fi xed on thepolluter and how is his liability to be quantifi ed. The perspective ofthe book is based on Indian law, but references to other jurisdictionallaws and international instruments have been made at appropriateplaces.
