By enacting the Dissolution of Muslim Marriages Act, 1939, the legislature made a distinct endeavour to ameliorate the lot of the Muslim wife, taking into account the circumstances of actual life and the change in people's habits and modes of living.
An attempt has been made to present to the reader, the analytical and subtle views of the ancient authorities, their scientific and scholarly expositions by the Indian writers, along with the judicial interpretations and applications of the law prior and after the 1939 legislative enactment. Keeping the special importance of the doctrine of stare decisis, the author has presented the subject in the most illuminating style, incorporating several judicial precedents of India. Some cases decided by Courts in Pakistan have also been included; and wherever possible an attempt has been made to give an analytical and juristic examination of the legal provisions and the decided cases.
